Towards Quality Economic Growth: An Overview of the Green Economy Legal Framework in Indonesia

March 10, 2026399 views

Economic growth is often seen as conflicting with environmental sustainability, especially amidst the global climate crisis and the commitments of the Paris Agreement. This article aims to examine the legal framework for a green economy in Indonesia and the extent to which regulations can promote decoupling between growth and emission pressures. Using a qualitative method through a multidisciplinary literature review and regulatory analysis, this study finds that Indonesia already has a fairly progressive legal foundation, such as the Presidential Regulation on Carbon Economic Value, carbon tax, carbon exchange (IDXCarbon), and sustainable finance taxonomy. However, implementation still faces regulatory fragmentation, weak MRV infrastructure, post-Omnibus Law uncertainty, and enforcement challenges. The article recommends the establishment of an umbrella climate change law, strengthening administrative sanctions based on strict liability, and harmonizing central-regional efforts to achieve quality and sustainable economic growth.
